to pay postage for all outgoing personal mail. The mail clerk lists all receipts and expenditures
or stamps by dollar value, the dates of receipts and expenditures, and maintains a running
balance of the total dollar value of stamps remaining in the prisoner's account. Stamps credited
to the account of prisoners in a pay status are maintained in a single bulk account. This account
is inventoried weekly and reconciled with the balances reflected on the individual accounts of
prisoners.
(b) Postage for all personal outgoing mail of prisoners in a nonpay status will be
furnished at government expense. Letters and postcards in their usual and generally accepted
form may be transmitted using the official postal markings "Postage and Fees Paid, Department
of the Army," subject to the following:
1. Official envelopes secured through normal supply channels must be used.
2. Return address will be the designation and address of the confinement facility
as prescribed previously.
3. Mail may not exceed 1 ounce in weight and will be limited to first-class mail
not requiring special services such as airmail or special delivery. Pictures and clippings that are
incidental to the message of the letter sent may be enclosed therein. Christmas cards and other
seasonal greeting cards will not be transmitted under the mail indicia.
e. Privileged mail is defined as all mail between a prisoner and the President, Vice President,
Members of Congress, Attorney General, The Judge Advocate General (TJAG) (or their
representatives), State and Federal Courts, defense counsel, or any military or civilian attorney of
record. Correspondence with any attorney, for the purpose of establishing an attorney-client
relationship, or for any purpose once an attorney-client relationship is formed, and all
correspondence with the inspector general or members of the clergy, will be regarded as
privileged. Privileged mail may be opened by a certified mail handler when there is a reasonable
basis for confinement facility personnel to believe that the mail contains contraband or when
there is reason to doubt its authenticity. Privileged mail must be opened in the presence of the
prisoner and the correspondence may not be read by anyone other than the prisoner without the
prisoner's permission.
f. Correspondence addressed to, or received from, the appropriate appellate agency of TJAG
of the department concerned will be delivered or forwarded without inspection except when
there is reason to doubt its authenticity or when there is reason to believe that the correspondence
contains contraband.
g. The prisoner will complete DA Form 2569R (Attorney of Record Designation [Civilian
and Individual Military Counsel]) (see figure 4-2) as soon as possible. Confinement facility
personnel must not open prisoners' mail with civilian or individual military counsel listed in DA
Form 2569R unless there is a reasonable basis for such personnel to believe the mail contains
contraband. Completion of the DA Form 2569R is not required for military appellate defense
or trial defense counsel detailed to represent the prisoner.
